By using the fluxpilot.app website (the "site") or the FluxPilot application you agree to these terms. If you do not agree, please do not use the site or the application. "The FluxPilot application" (or "the application") means the FluxPilot software for designing utility-scale battery energy storage systems, however we deliver it to you: in your browser at studio.fluxpilot.app, or as installable software that we may provide to some customers. These terms apply to both.
If you or your organization has signed a license, pilot, or evaluation agreement with us, that agreement governs your commercial relationship with us (seats, term, fees, support, and any negotiated terms), and where it conflicts with these terms the signed agreement controls. These terms apply to your use of the application alongside that agreement, and the application will ask you to accept the current version of these terms when they change.
You need an account to use the application. Each account is for one named person. Keep your credentials confidential, do not share them, and do not let anyone else sign in as you. You are responsible for everything done under your account until you tell us it has been compromised. Give us accurate account information and keep it current.
Accounts belong to an organization. Your organization's administrators may see and manage the projects, libraries, and files shared within the organization, add or remove members, and change your access. We may suspend or close an account that violates these terms or that we reasonably believe presents a security risk to the application or to other customers.
The projects, equipment libraries, documents, and files you create or upload in the application ("your content") are stored in your account on our infrastructure at Amazon Web Services (United States) so that you can work on them from a browser and share them within your organization. When you use installable software we provide, some content may also be kept on your device.
Your content remains your content. You grant us only the limited license we need to host, process, display, transmit, and back up your content in order to provide the application to you and your organization, to support you at your request, and to comply with law. We do not use your content to train any machine-learning model, and we access it only to operate the service, to support you at your request, or as required by law. You are responsible for having the rights you need to upload your content, and for keeping your own copies of anything you cannot afford to lose.
The application itself, including its software, sizing and layout engines, equipment data we supply, documentation, and the FluxPilot name and marks, is owned by Fluxara LLC or its licensors. Subject to these terms and to any signed agreement, we grant you a limited, non-exclusive, non-transferable right to use the application for your organization's internal business purposes during your license term.
While your account is active you can export the outputs the application produces at any time, and you can ask us for a copy of your stored content. When your license term ends or your account is closed, we will provide a copy of your stored content on request for 30 days, and we may limit access to the application during that period. We delete your content and your account data from our active systems within 60 days after your license term ends, and from backups within 90 days, except for records we need for billing, security, or legal compliance. If you want your content deleted sooner, email us and we will act on the request.
The application can read a document you choose to import, such as an equipment datasheet or a spreadsheet, and propose values for a library record or a project. When you use this feature, the document you selected, together with our instructions and the structure of the record being filled, is sent to Anthropic, PBC (United States), the provider of the Claude models, through Amazon Web Services, for processing on our behalf. Anthropic does not use content submitted through its API to train its models and retains it only for a limited period, as described in its commercial terms. Nothing is sent unless you start an import, and you can always enter records by hand instead.
Values proposed by this feature are extracted automatically and may be incomplete or wrong. They are shown to you for review before anything is saved, and you are responsible for checking them against the source document before relying on them. The "Engineering outputs and no professional advice" section below applies to every value entered this way.
The application sends anonymized diagnostic and product usage data to us so that we can improve the product and resolve bugs. By using the application you agree to this, and you can turn it off at any time in the application under Settings, General, "Share anonymous usage data". The data consists of feature usage events (for example that a sizing run or a layout export happened), performance measurements, error and crash reports, the application version, your browser type when you use the application in a browser, and your operating system. It is sent through our own domain and processed by PostHog, Inc. (United States) on our behalf.
Your confidential data is not part of this diagnostic data. Project files, equipment libraries, site boundaries, drawings, weather and rate lookups, and any other project content are never uploaded by this mechanism. Error reports may include an error message and a stack trace; when you use installable software we provide, file paths are removed before the report leaves your device. Where the application stores your content, and what happens when you import a document with AI assistance, is described in the sections above.

Sign-in to the application is handled by WorkOS, Inc. Our own infrastructure at Amazon Web Services checks that your account holds a valid license and that your use stays within its limits, such as the number of seats and concurrent sessions your organization has licensed. To do this we process your account email, your organization membership, sign-in events, and, when you use installable software we provide, an identifier for the device the software is installed on. We may end a session or refuse access when a license check fails.
The application is at an early stage and is provided "as is" and "as available". We do not promise any particular uptime, and we do not offer a service level agreement unless a signed agreement with you says otherwise. We may take the application offline for maintenance, with notice when we can give it, and it may be interrupted by causes outside our control. We may add, change, or remove features at any time, and we may release updates to installable software that you must install to keep using it. Where reasonably practicable we will give notice before we discontinue the application or remove a material feature.
You may use the site and the application only lawfully and as they are intended to be used. You agree not to:

We rely on third-party providers to deliver the site and the application. They include Amazon Web Services (hosting and infrastructure, United States), WorkOS (sign-in), PostHog (diagnostic and product analytics), Anthropic through Amazon Web Services (AI-assisted import), Cloudflare (bot protection and web analytics), Google Calendar (demo scheduling), and Microsoft Clarity (website session insights). Each processes data only on our behalf. The Privacy Policy lists these providers and what each one receives, and we will update it if we add or replace a provider. The application also retrieves weather, electricity rate, and map data from third-party data sources; that data is subject to those sources' own terms and accuracy limitations.
Sizing, layout, augmentation, degradation, and weather results produced by the application are engineering aids. They depend on the inputs, assumptions, equipment data, and third-party datasets that you and we supply, any of which may be incomplete or wrong, and they are not a substitute for professional engineering judgment, stamped or sealed drawings, interconnection or grid studies, site surveys, code compliance reviews, or manufacturer warranties. Every output is a preliminary draft that must be independently reviewed and approved by qualified professionals before it is relied on for any project, procurement, financing, permitting, or safety decision. Content on the site is general information about our product; it is not engineering, legal, or financial advice, and neither the site nor the application is a warranty of any result.
All content on this site, including text, graphics, the FluxPilot name, mark, and wordmark, and the animations and illustrations, is owned by Fluxara LLC and is protected by intellectual-property laws. You may not reproduce, distribute, or use it commercially without our written permission.
Submitting a demo request does not create any obligation on either side. Any evaluation or purchase of FluxPilot is governed by the agreement we sign together at that time.
The site, the application, and all of their content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site or the application will be uninterrupted, error-free, or free of harmful components, or that any output will be accurate or fit for any project.
To the maximum extent permitted by law, Fluxara LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the site or the application, including any decision made in reliance on an output of the application. To the maximum extent permitted by law, our total liability for any claim relating to the site will not exceed one hundred US dollars (USD 100), and our total liability for any claim relating to the application will not exceed the amount your organization paid us for the application in the twelve months before the claim arose or, if nothing was paid, one hundred US dollars (USD 100). Where a signed agreement sets a different limit, that limit applies instead.
You agree to hold Fluxara LLC harmless from claims arising out of your misuse of the site or the application, your content, or your violation of these terms.
The site may link to third-party sites or services. We are not responsible for their content or practices, and linking does not imply endorsement.
These terms are governed by the laws of the State of Illinois, where Fluxara LLC is registered, without regard to its conflict-of-law rules.
We may update these terms from time to time. The date and version at the top of this page reflect the latest revision. Continued use of the site after a change means you accept the updated terms. The FluxPilot application will present the updated terms for acceptance before continued use.
